Patients' rights

1.    Patient Rights

Healthcare services may only be provided to patients with their free and informed consent, unless determined otherwise by applicable law.

The patient has the right to healthcare services provided on a due professional level.

In addition, during the provision of healthcare services the patient has the right to:

  • respect, to be treated with dignity, courtesy and respect for privacy in the provision of healthcare services in accordance with the nature of the provided healthcare services;
  • select a healthcare provider authorised to provide healthcare services that meet the patient's needs, and a healthcare facility, unless determined otherwise by the applicable law or other legal provisions,
  • request consultation services from a different provider and/or healthcare professional than the one providing healthcare services to them; this does not apply during the provision of emergency, or to care provided to persons in custody, serving a prison sentence, or in security detention,
  • be informed about the internal rules of the healthcare or day care facility (hereinafter referred to as "internal regulations"),
  • the permanent presence of their legal guardian, or a designated legal representative, foster parent or another person in whose care the patient has been entrusted based on a court decision or the decision of another authority in the case of a minor,
  • permanent presence of a guardian, or a person designated by the guardian if they are a person whose legal capacity is limited so that they are not able to evaluate the provided healthcare services or the consequences of their provision (hereinafter referred to as "patient with limited legal capacity"),
  • the presence of relatives or a person designated by the patient in accordance with other legal provisions and internal regulations, and if such presence does not disrupt the provision of healthcare services; this does not apply in the case of persons in custody, imprisonment or security detention,
  • be informed in advance about the price of the provided healthcare services not covered or partially covered by public health insurance, and about the method of payment thereof, provided that the patient’s health condition allows it;
  • know the name(s) and surname(s) of healthcare professionals and other professionals directly involved in the provision of healthcare services, and of persons being trained by the provider for their healthcare profession who are present during the provision of any healthcare services and/or who perform activities forming part of their training;
  • refuse the presence of persons not directly involved in the provision of healthcare services and of persons being trained for their healthcare profession;
  • receive visitors in a healthcare facility providing inpatient or one-day care, with respect to their health and in accordance with the internal rules and in a manner that does not violate the rights of other patients unless determined otherwise by this law or other legal provision,
  • receive in a healthcare facility providing inpatient or one-day care spiritual care and support from priests and religious communities registered in the Czech Republic or from persons entrusted with the performance of religious activities (hereinafter referred to as a "priest") in accordance with the internal rules and in a way that does not violate the rights of other patients, and respecting the patients's health condition, unless the law determines otherwise; the visit of a priest cannot be denied to a patient in the case of a threat to their life or serious damage to health, unless determined otherwise determined by law,
  • the provision of healthcare services in a minimally restricting environment while ensuring the quality and safety of the provided healthcare services.
  • A patient with limited legal capacity or who is a minor may request that their legal representative or a person designated by the legal representative, foster parent, guardian or a person designated by the guardian or another person in whose care the patient has been entrusted based on a decision of a court or another entrusted body states that this is a person who mistreats or abuses or neglects them not be present during the provision of healthcare services.
  • A patient with sensory disabilities or with severe communication problems caused by their health condition, as in the case of interpreting a foreign language, with the exception of the Slovak language, has the right, as part of the communication related to provision of healthcare services, to communicate in a way that is comprehensible to them and using a means of communication that they choose, including methods based on interpreting by a second person.
  • A patient with sensory or physical disabilities who uses a specially trained dog has the right with respect to their current state of health to be accompanied by and be in the presence of the dog in the healthcare facility, in the manner stipulated by the internal regulations so that it is not in violation of the rights of other patients, unless determined otherwise by the law. For the purposes of the first sentence, a specially trained dog shall be understood as a guide dog or an assistance dog.

 

2.    PATIENT DUTIES

  • To prove their identity with a document (identity card or passport) and to submit their insurance card.
  • To sign a written informed consent to hospitalisation and the provision of information. Where this is requested in the MMN, to sign an informed consent to the provision of healthcare services. The list of procedures that this provision relates to is published on the hospital website.
  • To truthfully inform healthcare workers about their health status and the drugs they use or take.
  • To behave decently, to observe the instructions of healthcare workers and other MMN employees, to adhere to the principles of social cohesion and good manners and to respect the privacy of their fellow patients.
  • To immediately inform the healthcare worker on duty about any serious change in their health status, or any adverse event that occurs, such as trauma, seizures, and even when they they witness such events in their fellow patients.
  • Patients, their escorts and all visitors are obliged to respect the instructions of all healthcare workers and abide by them. Failure to respect the instructions of healthcare workers constitutes a serious violation of the internal rules of the healthcare facility and is a reason for the premature termination of treatment.
